THIS AGREEMENT CONSTITUTES THE TERMS AND CONDITIONS UNDER WHICH THE ISSUER GOLD2NAIRA.COM THAT IS FULLY OWNED AND OPERATED BY "Ekebs Global Limited" WILL PROVIDE ITS SERVICES TO USER. IT EXPLAINS THE RIGHTS AND OBLIGATIONS OF USER TO THE SERVICES PERFORMED BY GOLD2NAIRA.COM

IT IS IMPORTANT FOR USER TO REVIEW THE AGREEMENT STATED IN THIS TERMS AND CONDITIONS CAREFULLY. REGISTRATION OF ACCOUNT UNDER GOLD2NAIRA.COM WEBSITE MEANS USER HAS READ CAREFULLY, UNDERSTANDS AND FULLY ACCEPTS ALL TERMS AND CONDITIONS PROVIDED IN THIS AGREEMENT.

GOLD2NAIRA.COM RESERVES THE RIGHT TO AMEND PERIODICALLY THIS TERMS AND CONDITIONS. THE REVISED VERSION OF GOLD2NAIRA.COM TERMS AND CONDITIONS TAKES EFFECT IMMEDIATELY WE POST ON OUR WEBSITE. YOUR CONTINUED USE OF GOLD2NAIRA.COM SERVICE AND ACCOUNT CREATED WITH US SHALL ESTABLISHED YOUR PRIOR AGREEMENT TO USE OF OUR SERVICE.

1. DEFINITION OF TERMS

1.1. Issuer: Means Gold2Naira, a company that is registered with Nigeria Corporate Affairs Commission to provide e-commerce service and operates any form of e-business services. And it is own and operate by Ekebs Global Limited.

1.2. Us/We/Our: Means Ekebs Global Limited, company that is registered with Nigeria Corporate Affairs Commission.

1.3. User: Means a person, whether individual or legal entity that creates an account with gold2naira.com and is consider as the sole owner of account created on our website.

1.4. Account: Means electronic account created by the user on www.gold2naira.com to perform electronic funding and electronic payment service.

1.5. Service: Means an electronic funding/payment service.

1.6. Website: Means the Internet website portal, a property of Ekebs Global Limited. available at www.gold2naira.com.

1.7. E-currency: It means electronic currency and is a means of exchange with which can be use to make and receive payments.

2. CONDITIONS OF USE.

2.1. In order to use Gold2Naira e-currency exchange services User must first open a User Account by registering on www.gold2naira.com. As part of the signup process User needs to accept these Terms of Use, Issuers Privacy Policy and Anti-Money Laundry Policy.

2.2. User may only open one Account per valid e-mail address.

2.3. User must provide Issuer with valid and accurate identifying information as determined by Issuer in the sign up process, Issuer reserves the right to verify said information from time to time. User's non-compliance with this condition of use will allow the Issuer to restrict the account without notice.

2.4. When opening an account User shall create two methods of identification in order to access and manage its Gold2Naira Account. Said methods are formed by e-mail and Password, hereinafter jointly referred to as Electronic Means of Identification or EMIDs. EMIDs are known only by User, and User must keep EMIDs secure enough.

2.5. User agrees to create a secure password when managing its EMIDS. In order to consider a password secure it shall (i) combine letters, symbols and numbers, (ii) not include users name or personal information, (iii) be different from the ones used in other website.

3. REGULATION ON PRODUCT AND SERVICE.

3.1. Gold2Naira provides the service of funding e-currency stored in form of United States Dollars (USD), Euro (EUR) and Goldgrams (GG) in the electronic payment systems, and also funding within different e-currency types and international currency.

3.2 Electronic payment systems and/or Banks are exclusively responsible for the monetary funds entrusted to them by the Users. Gold2naira.com is not a party to the agreement between an Electronic payment systems and its User, is by no means responsible for misuse or abuse of the corresponding system and/or a Bank as well as for functionality abuse of this system by the User.

3.3. Mutual rights and duties of the User and the electronic payment system and/or a bank are regulated by the rules and agreements accepted in the corresponding system and/or a Bank.

3.4. Third party payments are not accepted. User who places the order on gold2naira.com has to pay for this order with his/her name. It is not accepted for other person/relatives or friends to pay on behalf of User .

3.5. We only have the right to check on User information and operation provided in the account on our website. We do not check the legal standing of the User, the monentary funds sent by User for purchase of e-currency. Therefore, we do not monitor User operations in any of the electronic payment systems or banks.

3.6. The services provided by us are primarily intended to serve Nigerians and we have the right to accept or reject international orders. International orders can be accepted provided User can be verified. User must be fully aware of the Local or National law and are solely responsible to be bide by such law.

4. TRANSACTIONS AND OPERATIONS.

4.1. Gold2Naira.com function is to provide the transaction fulfillment and/or the following operations, access to the information about the transaction in the gold2naira.com admin portal and to carry out the transactions or any of its parts by the User within 24 hours a day, 7 days a week and 365 days a year.

4.2. The payment made by the User is subject to current rate on the website at the time he/she place order on gold2naira.com system. The payment for the services is only carried out by the User according to the gold2naira.com services rates. However, we have the right to change the service rate without prior notification.

4.3. Aside from the established service rate, in an instance that fees and commissions are involved on the electronic payment system or banks, the User pays all the fees and commissions, done on the basis of business relation with gold2naira.com. These additional expenses are written off by Us in non-acceptance manner from the monetary funds of the User which are in the disposal of Gold2Naira.com.

4.4. For security reasons, we do not accept or make cash payments that is more than N20,000 in our office. All transactions are made through our bank accounts listed on the account funding page which is only visible at buy page.

4.5. User is responsible for the functionality and usability of the devices - Desktop, Laptop, Tablet PC, Smart Phones and/or some other facilities necessary for the access to the transaction settlement system through gold2naira.com. We will not be held responsible for the losses or damage that occured as a result of inability of the User to use his own facilities and/or some of its elements and/or the absence of the necessary full or partial functionality of the facilities or its elements.

4.6. Any claim on the part of the User of improper fulfillment of User instructions by gold2naira.com must be brought to Our notice by the User not later than seven (7) business days after the date gold2naira.com was given the corresponding instructions.

4.7. Gold2Naira.com is not responsible for any loss and/or damage, resulting from a delay in bank payments fulfillment or electronic money transfer of the User where the day of sending or the days after sending are not working days in the country of the gold2naira.com partner-participant, that is the receiver.

4.8. Gold2Naira.com is not responsible for mistakes, omissions or delays of payments made by banks, serving gold2naira.com partners-participants, by a correspondent bank or e-payment system as well as it is not responsible for the consequences caused by their financial state.

4.9. Gold2Naira.com will not be held liable for any mistakes in an event where User mistakenly supplied wrong account details on our website.

4.10. Gold2Naira.com has a right to limit the access of the User to Our website without prior notification of the User, at the same time gold2naira.com is not responsible for any indirect, special, unpredictable or consequent loss or damage.

5. PROCESSING TIME AND NOTIFICATIONS:

5.1. We try our best to process all orders same day or within 24 hours. However, for some reasons like scarcity, demand higher than supply, availability, and so many others, orders maybe be delayed. You agree to be patient and not use any kind of threat or abusive words on any of our staff or representative.

6. VERIFICATION.

6.1. All users submitting their first order, maybe be asked to undergo verification procedure upon receipt of funds by Gold2Naira (Ekebs Global Limited):

6.2. User will be asked to provide scanned copy of valid National ID Card, International Passport or Driver's License. ID or Driver's License must include user's signature. If ID or driver's license does not include user's signature, user will be asked to also email scanned copy of valid passport.

6.3. User may be asked to provide a scanned copy of recent utility bill or bank statement showing current address of residence.

6.4. User may be asked to provide a scanned copy of signed agreement confirming user's order.

6.5. Signature on the agreement must match signature on the ID or driver's license.

6.6. User sending funds on behalf of a company or organization will be asked to provide documents proving the authority of the user to dispose of the funds (being the director or executive of the company, providing registration documents or valid invoice or company's register record).

6.7. User may be asked to provide additional unspecified documents or proof of authenticity.

7. TERMINATION.

7.1. We reserve the right to terminate, reject or cancel any order at our sole discretion to the User if; i) User violates any of the conditions provided in this Agreement or any amended agreements.
ii) User transferred money from other person account, involved in identity theft or has used another persons ATM Card, electronic payment system information under false pretence.
iii) User refuses to submit required verification documents, or verification of the User identity fails through. Also if there is a reasonable suspicion that verification documents provided by potential User are invalid or illegally modified.
iv) We has the right to terminate any order if the purpose of payment transactions and the source of funds used for payment transactions are restricted or forbidden by applicable anti-money laundering policy.

8. REFUNDS.

Payments are final and not reversible except those cases which provided in Terms and Conditions.
i) Funds can be refunded if it was sent under the different name which does not carries User name/Order ID.
ii) Funds can be refunded if the purpose of payment is not clear.
iii) We reserves the right to refund User funds without mentioning the reason.

10. AMENDMENT.

10.1. Gold2Naira.com reserves the right to make periodically any amendments and changes to the rules of product (services) usage , as well as service and access to services , including the present Agreement and any \"Additional Agreements \", at any time.

11. YOUR ACCOUNT SECURITY:

11.1. You are totally responsible for the security of your account. Account compromising is common and we neither have access nor a way of accessing your account. Please read our security recommendation on how to protect your account.

12. GUARDING, ACCESS AND CONNECTION.

12.1. Any reference of the User to Gold2Naira, be it electronic, written or oral, will come into force and will be valid only after its full reception by gold2naira and correct identification of the User as the owner of the monetary funds, at the same time the User as the Owner of monetary funds will be responsible for all operations on his account.

12.2. Written messages of gold2naira.com to the User are considered completed since the moment they were sent to the last email address of the User known to gold2naira.com.

13. EXTERNAL LINKS DISCLAIMER.

13.1. The appearance of external links and banners on this website does not constitute endorsement by Gold2Naira. (the Issuer of the e-currency exchange service) or Ekebs Global Limited (the operator of the website).

14. FORCE-MAJEURE.

14.1. Neither User nor Issuer will be responsible for the delays or default on an obligation under the present Agreement or any \"Additional agreements \", contracts and/or arrangements resulting from force-majeure, including (unrestricted) acts of God, acts of government or state, wars, fire, earthquake, flood, explosion, terrorism, riot or civil strike, or absence of; malfunctioning of power supply, internet providers or network connections or other systems, networks or services.
